Welcome to TagStack.io! By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of TagStack.io, including those on paid subscription plans.

1. Definitions

  • Service: The GTM scanning and technology lookup services provided by TagStack.io
  • User: Any individual or entity using TagStack.io
  • Credits: Paid tokens providing access to premium tagstack features (scan, technology lookup and lead list exports)

2. Accounts

  • Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement.
  • Registration: You must provide accurate and complete information when creating an account.
  • Account Security: You are responsible for maintaining the security of your account.

3. Credits & Fair Usage

  • Billing: Credits cannot be bought individually and are always purchased in bulk. The quantity and credit cost is determined by the user at the time of his purchase. Credits remain active on user's account until used or when the user cancels his account. In that latter case, credits do not get refunded.
  • Usage Limits: New users get granted a free scan. "Unlimited searches" are subject to fair use policy.
  • Enterprise Plans: Are exempt from standard fair use restrictions.

4. Service Usage & Limitations

  • Public Data Only: Our Service exclusively scans and analyzes publicly available data from websites. We do not require or accept access to any internal systems, private data, or protected information.
  • Access: The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service without prior notice.
  • Rate Limits: To ensure service stability, we implement rate limiting on API requests and scans. Excessive automated requests may result in temporary access restrictions.
  • Data Accuracy: While we strive for accuracy, we cannot guarantee that all technology detection and GTM container analysis results are 100% accurate or complete.

5. User Conduct & Restrictions

  • Prohibited Activities: Users may not:
    • - Attempt to reverse engineer the Service or our detection methods
    • - Share account access with unauthorized users
    • - Use the Service to harm or harass others
  • API Usage: API access is restricted to authorized users and must comply with our API documentation guidelines.

6. Data & Privacy

  • Public Data Collection: Our Service only collects and analyzes data that is publicly accessible on websites. We do not:
    • - Access any password-protected or private areas of websites
    • - Collect personal information beyond basic account details
    • - Require access to internal systems or private configurations
    • - Store or process sensitive business data
  • Account Data: The only personal data we collect is what you provide for your account (email) and basic usage data (scans history, saved scan).
  • Data Retention: Scan history and results of public website analysis are retained for the duration of your active account.
  • Data Collection: We collect scan results and usage data to improve our Service and provide analytics.
  • Data Sharing and Usage: While we do not directly sell individual scan results, we reserve the right to:
    • - Use and analyze scan results to improve our services
    • - Create and share industry reports and analytics based on aggregated data
    • - Provide technology usage insights through our platform's features and tools
    • - Process and store scan results as part of our service delivery (e.g. for scan snapshots)

    By using our Service, you grant us the right to collect, process, and utilize scan results in accordance with these terms and our Privacy Policy.

  • Data Rights

    • Scope of Data Collection: Our Service exclusively processes publicly available website data. We do not:
      • - Request or accept credentials for private systems
      • - Access non-public areas of websites
      • - Collect personal data beyond basic account information
    • License Grant: By using the Service, you grant TagStack.io a worldwide, non-exclusive, royalty-free license to use, process, and analyze the public data gathered through your use of the Service.
    • Data Usage: This includes the right to:
      • - Analyze public GTM configurations and technology implementations
      • - Generate and distribute market intelligence based on public data
      • - Improve our technology detection capabilities
      • - Create derivative works based on aggregated public data
    • Ownership: While you maintain ownership of your account data, TagStack.io owns all derivative works and aggregate insights generated from the Service's collection of public website data.

7. Intellectual Property

  • Ownership: All rights, title, and interest in the Service, including all intellectual property rights, remain with TagStack.io.
  • License: Users are granted a limited, non-exclusive license to use the Service for its intended purpose.
  • User Data: You retain all rights to your account data.

8. Termination

  • Account Closure: You may close your account at any time. Unused credits are not refunded upon closure.
  • Termination by TagStack: We reserve the right to suspend or terminate accounts that violate these terms or pose a security risk.
  • Effect of Termination: Upon termination, you lose access to all paid features and stored scan results.

9. Liability & Warranties

  • Disclaimer: The Service is provided without any warranties, express or implied.
  • Limitation of Liability: TagStack.io's liability shall be limited to the amount paid for credits in the last 12 months.
  • Indemnification: You agree to indemnify TagStack.io against claims arising from your use of the Service.

10. Changes & Updates

  • Terms Updates: We may update these terms at any time. Continued use of the Service constitutes acceptance of updated terms.
  • Service Changes: We reserve the right to modify, add, or remove features without prior notice.
  • Notification: Material changes to these terms will be communicated via email or in-app notifications.

11. Support & Communication

  • Support Hours: Customer support is available during business hours (CET timezone).
  • Response Time: We aim to respond to all inquiries within 24 hours on business days.
  • Communication Channels: Support is provided via email at [email protected] and through our in-app chat system.
